These Terms of Use ("Terms") govern your use of the Frostik mobile application ("the app"), developed and operated by Honest Dev LLC ("we", "us", "our"). By downloading, installing, or using Frostik, you agree to these Terms.

1. Health and Safety Disclaimer

Cold exposure carries inherent health risks. Frostik is a timer and tracking tool only. It does not provide medical advice, diagnosis, or treatment. Cold water immersion and cold exposure can be dangerous and may cause hypothermia, cardiac arrhythmia, cold shock response, or other serious health complications.

You must consult your doctor before starting any cold exposure practice, especially if you have cardiovascular conditions, Raynaud's disease, high blood pressure, epilepsy, or any other health conditions. Frostik is not a substitute for professional medical advice. You use this app and engage in cold exposure entirely at your own risk.

2. Eligibility

You must be at least 13 years old to use Frostik. By using the app, you confirm that you are at least 13 years old and are not located in a country subject to a U.S. government embargo or designated as a "terrorist supporting" country.

3. Your Data

All session data, streak history, and preferences are stored locally on your device. We do not operate backend servers or cloud databases for user data. For full details, see our Privacy Policy.

You are responsible for backing up your device. If you delete the app or lose your device, locally stored data cannot be recovered.

4. Subscriptions and Payments

Frostik offers the following auto-renewable subscription plans:

Payment is charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current billing period. You can manage and cancel subscriptions at any time in your device's Settings > Apple ID > Subscriptions.

If a free trial is offered and you subscribe before the trial ends, the unused portion of the trial is forfeited. Refunds are handled according to Apple's refund policy.

You agree to use Frostik only for its intended purpose as a personal cold exposure timer and tracking tool. You may not:

By using Frostik, you acknowledge that cold exposure is an inherently risky activity. You voluntarily assume all risks associated with cold exposure, including but not limited to hypothermia, cold shock, cardiac events, and injury. You agree that Honest Dev LLC is not responsible for any injury, illness, or death resulting from your use of cold exposure techniques, whether or not guided by the app.

7. Intellectual Property

All content, design, code, and intellectual property in Frostik is owned by Honest Dev LLC or its licensors. All rights are reserved. You are granted a limited, non-exclusive, non-transferable license to use the app for personal, non-commercial purposes.

8. Limitation of Liability

Frostik is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by applicable law, Honest Dev LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, personal injury, or any damages arising from your use of or inability to use the app or from engaging in cold exposure activities.

9. Termination

We reserve the right to terminate or suspend your access to the app at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the state in which Honest Dev LLC is incorporated, without regard to its conflict of law provisions.

11. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the app or by updating the "Last updated" date on this page. Continued use of the app after changes constitutes acceptance of the updated Terms.
